What are grounds for divorce in Florida?
Florida’s a no-fault state. There are only two grounds for divorce in Florida. One is that the marriage is irretrievably broken, which means that the marriage just can’t be fixed. The other one is for mental incapacity. That reason’s hardly ever used because it takes a long time of mental incapacity to prove your case in that type of a situation. So people often think that they’re going to get a divorce because of emotional abuse or because of infidelity. But in Florida, those are not the grounds for divorce, we’re a no-fault state.
